Grievance Procedures

The purpose of this procedure is to provide a prompt and equitable means of resolving student grievances. These procedures shall be available to any student who reasonably believes a college decision or action has adversely affected his or her status, rights or privileges as a student. The procedures shall include, but not be limited to, grievances regarding:

  1. Sex discrimination as prohibited by Title IX of the Higher Education Amendments of 1972
  2. Sexual harassment
  3. Other illegal harassment or discrimination
  4. Financial aid
  5. Course grades, to the extent permitted by Education Code Section 76224(a), which provides: "When grades are given for any course of instruction taught in a community college district, the grade given to each student shall be the grade determined by the instructor of the course and the determination of the student's grade by the instructor, in the absence of mistake, fraud, bad faith, or incompetency, shall be final." "Mistake" may include, but is not limited to errors made by an instructor in calculating a student’s grade and clerical errors.
  6. The exercise of rights of free expression protected by state and federal constitutions and Education Code Section 76120.

This procedure does not apply to:

  1. Student disciplinary actions, which are covered under separate Board policies and Administrative Regulations;
  2. Police citations (i.e. "tickets"); complaints about citations must be directed to the criminal justice system in the same way as any traffic violation.

Student Complaint Procedures

Thank you for taking steps to bring your issue to our attention. This will provide you with the guidelines needed to assist you in submitting and resolving your student appeal or complaint. Please follow the course of action outlined below, as stated in the Fresno City College student handbook.

Any complaint concerning an alleged unauthorized or unjustified act or decision by a staff member not involving sexual harassment and/or discrimination which adversely affects the grade, status, rights, or privileges of a student is the concern of the Fresno City College administration. A student who has a complaint may take action in the following sequence:

  1. Discuss the problem with the individual involved to try and find a resolution. 
    • If the student has a complaint against an instructor and a resolution has not been met, student must speak with the instructor's dean to attempt to resolve the matter. 
    • If the student has a complaint against a non-instructional employee, student must speak with the non-instructional employee's direct supervisor.
    • If the student has a complaint against a student or other non-employee, student can proceed to Step 2.    
  2. If a mutually satisfactory understanding has not been reached at Step 1, please submit a Student Complaint Form with the link below.  
    • The Dean of Student Services and/or designee will review the complaint and will assign it to the appropriate manager. 
    • The assigned manager will contact the student to address the complaint.
  3. If the student’s concern(s) remains unresolved after Step 1 and Step 2, the student will be advised they may take the matter to the appropriate vice-president for further consideration.

Definitions:

The student or any persons claimed to have been responsible for the student's alleged grievance, together with their representatives. "Party" shall not include the Grievance Hearing Committee or the College Grievance Officer.

The Chancellor or a designated representative of the Chancellor.

A currently enrolled student, a person who has filed an application for admission to the college, or a former student. A grievance by an applicant shall be limited to a complaint regarding denial of admission. Former students shall be limited to grievances relating to course grades to the extent permitted by Education Code Section 76224(a).

Any person claimed by a grievant to be responsible for the alleged grievance.

Unless otherwise provided, day shall mean a day during which the college or center is in session and regular classes are held, excluding Saturdays and Sundays.
